Congestion and Trucker Embargo at Toronto's Intermodal
Container Terminals

Dear Mr. Collenette,
We are writing with respect to the demands of independent truckers for compensation for long waiting
times at container terminals operated by CN Rail at Brampton, and at CP Rails intermodal terminals at
Vaughan and OBICO, which are seriously stalling operations at these terminals.
Although the terminals are offering incentives to receivers to pick up cargo during the weekend period
in order to clear the logjam of containers at their facilities, intimidation tactics are being employed
to ensure that trucking companies do not dispatch trucks accordingly. The accompanying information
documents will bring you up to date on the situation.
There are two important issues at stake. First, the intimidation tactics and violence have overtaken
reason, leaving cartage companies unable to conduct normal business. Second, although CN and CP are
deploying their own police forces, local police and security appear to be unable to provide public
protection to drivers, companies and rigs.
Heading into this weekend, the intermodal terminals are open for business if the trucks are able to
arrive. However, several cartage companies have already declared that they will not send trucks over the
weekend for fear of personal injury or vandalism to their vehicles. In summary, it is not expected to be
a busy weekend at the terminals.
We are deeply concerned about the all too real possibility of a system-wide shutdown should congestion
at the Toronto terminals continue to grow. On Thursday, CN sought relief by not loading containers at
Montreal. Repetition of such action could move the congestion all the way back to the ports.
The Shipping Federation of Canada, the Canadian Freight Forwarders Association, and the Canadian
Importers Association are all keenly interested in this situation and have liaised with various other
associations to maintain a steady flow of information. Although the key message at this point is to
encourage receivers to remain open over the weekend to receive cargo, this is not likely to occur unless
safety concerns are addressed.
